Effective date: October 8, 2026
1. Acceptance. When you use the "Set the place on the map" feature, the Tool asks you on screen to agree to these terms and the Privacy Policy. If you do not agree, the map feature cannot be used. For all other features, by using Ezo Hazel Plantner ("the Tool"), you agree to these terms. If you do not agree, please do not use the Tool.
2. What the Tool is. The Tool is a free planning aid for hazelnut orchards. Tree counts, yields, work efficiency, pollination checks, hardiness zones, variety suggestions and all other figures are estimates calculated from your inputs and from published data (for example USDA hardiness zones by ZIP code, which can differ from the conditions on your actual land). The Tool does not replace a site survey, a land surveyor, or advice from an agronomist or other expert. Check the site in person before acquiring land, staking, buying or planting.
3. Beta. The Tool is in beta and may contain errors or change without notice. We may change, suspend or stop the Tool at any time.
4. Your data. Your plans are stored in your own browser (see the Privacy Policy). You are responsible for keeping backups. We are not responsible for data lost because browser data was cleared, a device failed, or a file was not saved.
5. Acceptable use. Do not misuse the Tool: do not attempt to disrupt or overload it or the services it connects to, do not scrape it in bulk, and do not use it unlawfully. Third-party map and data services have their own terms, which apply to your use of them through the Tool.
6. Intellectual property. The Tool, its design, name and logo belong to Ezo Hazel Orchard. Plans and drawings you create belong to you. You may print, share and use the drawings you export for your own orchard planning. You may not copy, resell or redistribute the Tool itself, or use it to build a competing service. Data sources are credited in the Tool (for example USDA/OSU PRISM, Geospatial Information Authority of Japan, OpenStreetMap contributors).
7. No warranty. The Tool is provided "as is" and "as available", without warranties of any kind, including accuracy, fitness for a particular purpose, or uninterrupted operation, to the extent permitted by law.
8. Limitation of liability. Except where the damage is caused by our intent or gross negligence, and to the extent permitted by law, we are not liable for any damage arising from your use of, or inability to use, the Tool (including crop loss, lost profit, and decisions made based on the Tool's figures). Nothing in these terms limits liability that cannot be limited under mandatory law, including your rights as a consumer.
9. Governing law and jurisdiction. These terms are governed by the laws of Japan. The Sapporo District Court (Japan) has exclusive jurisdiction of first instance over any dispute arising from or related to the Tool or these terms, to the extent permitted by law.
10. Changes. We may update these terms; the updated version applies from its effective date. Continued use means you accept the changes.
